Legal Report, Old Kmart Property Top Hefty Village Board Agenda

Oak Lawn trustees will vote on an A-L consent agenda and decide if village should release confidential legal report or fight a FOIA release at taxpayers' expense.

It’s another monster agenda for the Oak Lawn Village Board, which returns to its bimonthly meeting schedule starting at 7:30 p.m. tonight (Tuesday) at Village Hall.

Oak Lawn trustees will be voting on an A-L consent agenda, plus approving a whole slew of zoning ordinances for the latest Advocate Christ Medical Center expansion. With election season fast approaching there is plenty to be yanked off the agenda and discussed under the newly adopted Roberts Rules of Order.

Read the hefty Oak Lawn Village Board Agenda for 9-11-2012.

Here’s what we’ll be watching:

111th Street/Cicero Ave. – Village board members will be voting on a resolution authorizing the execution of a Memorandum of Understanding between the Village of Oak Lawn and HP Stony Creek LLC regarding the development of the old Kmart property owned by the village. Illinois Secretary of State records list James and Paul Sheridan, Todd Berlinghof and Mark Hamilton of 300 Park Blvd. in Itasca as managing partners. Hamilton Partners is the name of the developer that is eyeing the property to purchase and turn into a new retail development. The company’s portfolio features a wide range of industrial, commercial, retail and land developments, including 30 retail developments around the Chicago region and Salt Lake City, UT.

Godfrey and Kahn Report – The Village Manager is requesting a motion of direction from Oak Lawn trustees on release of the confidential legal investigation report into the former village attorney now known as Tressler LLP. The law firm has declined to defend the decision to keep the report from being publicly released in response to a Freedom of Information Act request. The village board on will decide whether to make the report public or fight its release at taxpayers’ expense.

What’s not on the agenda – Fall On the Green 2011 audit and retaining Progressive Energy Group’s consultancy services for negotiating a rate with an alternative electricity supplier.

The Oak Lawn Village Board meets at 7:30 p.m. on the second and fourth Tuesdays of every month at Village Hall, 9466 S. Raymond Ave. The meetings are free and open to the public.

Pertaining to the K-Mart location:
Is this just another "YOU MUST PASS THIS TO FIND OUT WHATS IN IT?"
Why not tell our O.L. Voters what, if any, stores have committed to long term leases.

I totally agree! We have all heard the dreams of a Trader Joes, etc., and supposedly some government official did say Trader Joes was interested but it all seems too vague. In the long run, as always, the tax payers in OL are gonna pay for it one way or the other... We need to focus on 95th Street as well, that is the center of town and we need to make that a focal point to lure potential businesses.

You would think that if they had any, especially with all the scrutiny on this project, they would have let slip by now...
I agree Robert...we cannot even keep 95th and Cicero filled, SW Hwy is a virtual ghost town, and there is no solid plan for 111th either...the area with a literal dead corner...
I want something that is of most service to the people of Oak Lawn and especially the residents in that area. There are already at least four major malls within fifteen-twenty minutes of that area (although, to be fair, Ford City is hardly an option for most and Evergreen is awaiting a supposed renewal that right now makes SW Hwy look like a happening strip...). This doesn't even include the major strip malls next to Chicago Ridge Mall, in Crestwood (including an OTB) or even Hodgkins/Countryside (same time it takes to go to Orland).
Until there are more middle class jobs to drive housing purchases, the demand for shopping/commercial will remain stagnant at best. People in the area, especially the seniors in the Cloisters' area, are barely making it on Aldi's prices, so maybe Aldi's sister store, Trader Joes's (brother store?) is indeed a dream.

Instead of another "dead shopping zone"; why not put in a park? Granted, I realize that the citizens of Oak Lawn could use the tax revenue but given the current status of Oak Lawn and the dead zones it currently has, a park could be a bold and innovative idea.

Dave W makes a very good point, the folks in the Cloisters are having a heck of a time with expenses, and if you look at Trader Joe's demographics, Oak Lawn hardly meets their requirements. I am happy to hear that Lou Malnatti's is coming to Oak Lawn, I thought they would never consider it, it will be an excellent addition to our busines district!

I RECEIVED A LETTER IN THE MAIL SHOWING SOME OF THE DEALINGS WITH TRESSLER LLP. IF THE REST OF THE INFO IN THIS REPORT IS SAYING WHAT THIS SAYS I'M SURE THEY DON'T WANT THE REPORT MADE PUBLIC BECAUSE OF THE VILLAGE'S GROSS NEGLECT IN USING OUR TAX DOLLARS!! ANYONE INVOLVED IN THIS COMING ELECTION BETTER HAVE SOME GOOD REASONS WHY THIS WASTE OF MONEY HAS CONTINUED FOR SO LONG! WE ALL WANT THIS EXPLAINED IN WORDS WE WILL UNDERSTAND. YOU POLITICIANS "HAVE" TO STOP TALKING IN CIRCLES AND NEVER ANSWERING OUR QUESTIONS!! IN OTHER WORDS "STOP LYING!!"

The lies are in the letter, Pat, and the liars are the authors and senders. It's a propaganda piece put out by Sandy Bury, featuring some omissions, significant half truths and some out and out falsehoods. So much for Bury's cries for honesty, integrity and transparency in government. And it's only September. We're going to have to put up with this sh...tuff until April.

Why can`t the village mow the grass on their property at 110th and Cicero Ave?

Essentially nothing in open meeting time...it was on the consent agenda, Trustee Phelan had it pulled off...asked some quick question, and it went away before anybody knew what happened.

So Dave W. do you now think that the village should get rid of the Consent Agenda since you couldn't figure out what happened?

metarzanyoujane,
I don't know that anybody said to get rid of the consent agenda. It wasn't just me, either, pretty much anybody you asked in the plebe-seats said the same thing.
From what the trustees I talked to afterward said (and also some fellow plebes after that), the whole development is still (and you will LOVE this) very confidential. I know, I'm shocked too. (sic) A huge plot of 'town' property, mostly un-or-under developed, the biggest development in years in the town, and we are STILL unable to announce anything because they don't have an anchor locked down yet...
At least the plans for the hospital look nice...still wonder what the cost will be to us, but you probably want that to be a secret too...just let us residents pay whatever the board decides (hopefully in a closed session), right?
(By the way, it is cute how you stalk me now...the time you must have on your hands...swamped with patients, aren't you?)

Dave W,
Thanks for checking in and letting us know that you now think it is ok to be stalked. I'm going to add one more fact to the profile: Very lonely guy! In any case, I am swamped but I can't let you get away running around with tin foil under your cap to ward off the invaders. Let's get right to the session.
First, Do you understand that the hospital is a private enterprise? It won't cost you anything unless you go in for that operation.
Secondly, telling everyone what is going into a development will cause a possible bidding war with other entities. How do you know the developer doesn't have an anchor locked down and it is using that information to negotiate (yes privately like most businesses in real estate do).Why do you care what store is going into a mall? WORRY more about how the Bears can beat the Packers. In other words, Man up!
Ok now that I've given you this pep talk I hope you won't be back looking for more attention any time soon.

metarzanyoujane,
Do you understand that the area around won't ALWAYS be funded by the hospital (nor should it, even)? That areas a bit away from the hospital, say, across 95th, still deal with traffic from there but are not directly involved in the (re)development? No, you didn't? Okay, we'll let you slide this time.
Still working to improve your horribly off base profile? Feel free to actually meet me for lunch one day, see how drastically wrong you have been...
Also, we know because three different trustees (from differing 'factions' no less) have SAID they have no anchor. So either they suddenly all have found 'unity' again, or they really do not have an anchor...everybody that lives in town should care what goes thefre...it matters what type of customers/clients/consumers are being attracted, what demographic PROFILE they fit (especially income to be spent-wise), will it help the most local of residents...how do you not 'get' this?
Worrying aboout the Bears is maybe what you do and why you don't understand why this importnat to others...that would explain a lot about you, actually...

I know you are a stickler for English based on the way you berated someone on another story. You said you are a plebe. Did you know that the use of the word plebian is obsolete. Plebian referred to the common people in ancient Rome. I don't think you are in ancient Rome. Today, a plebe is a member of the fresman class of the military academy. Again, probably not you!

D. 666, or, Stalker Number Two, as you can now be known as, I'm not sure how 'obsolete' a word is when it is in the first three dictionaries on Google...especially when it is the top defintion in one of them. (Though, in your defense, I'm just as surprised about that as you are...then again, in your non-defense, you thought the word was obsolete...) We are NOT in ancient Rome. Which is why you should probably use this whole interweb thingy to look up stuff before you try and flex your (lack of) knowledge. Still feel big and bad and tough? First you miss on logic, then you miss on easily attainable facts. Keep trying, since you two (I know "Grammar" is one of you two, duh...) are clearly now obsessed with me...which is weird, because I actually agree with you two when I, you know, have reason to agree. Huh...wonder what your buddy would 'profile' that as?
(Lastly, I'm WAY too old to be a freshman in any military academy, so yeah, you got that one right...attaboy! [Pat on back...])

Actually, the dictionary for Merriam-Webster lists the first definition for plebian as " a member of the Roman plebs". Again, this is not one of those instances where you can say, "when in Rome". The free dictionary.com has its first definition of plebian, and thereby its best as "Of or relating to the common people of ancient Rome". Dictionary.com says plebs are "the common people, as contrasted with the patricians and later with the senatorial nobility or the equestrian order". Let's remember Davey W. you used the word "plebs" not the word "plebian".
So yes, much like your comments, the word Pleb is obsolete. I was amazed that you didn't argue that you are not in the freshman class of a military academy.
In any case, why were you back here when there are other stories for you to comment on. Come on now, you are no ordinary guy or common guy. It is time to sit down read that massive legal report and mesmorize us with your skills of decifering what it means to the regular guy. You can do it!
