Worth Township Denies Freedom of Information Request Seeking 102 Documents

Worth Township Community First slate claims incumbents are using stall tactics to keep information from being made public before April 9 election.

Worth Township Supervisor John “Jack” Murphy says that political opponents in the upcoming election are harassing the township board through a recent freedom of information act request seeking 17 years’ worth of financial records.

Evergreen Park-resident John Wazio filed six requests last month seeking Worth Township budgets, audits and elected officials’ credit card receipts—102 documents in total—dating back to 1996.

The township denied the request, even though the documents are public records, deeming Wazio a “repeat filer.”

The scope of the request covers the period that the core of the current township board have been in office—including Murphy, assessor John Toscas, clerk Roger Benson, and township trustees John “Jack” Lind and Michael Mahoney--who were elected in 1997.

All are running together on the United Party of Worth Township slate.

The township’s denial of the financial documents—which are public records—most likely will not come under the public scrutiny until after the April 9 election, Hughes said.

“For the last 16 years, part-time [township elected officials] have participated in a full-time township employee benefits program,” Hughes said. “This goes into the basis of the freedom of information act request that we’ve been rejected on.”

The “repeat filer” rule was added to Illinois’s Freedom of Information Act in 2010, which is designed to prevent government bodies from being harassed by repeat filers requesting information that is unchanged or identical to previous requests within a 12-month period.

An individual submitting more than two freedom of information requests can be deemed a “repeat filer,” provided that a government body has responded to the individual’s previous requests either by denial or releasing the requested documents.

Hughes said the “repeat filer” statute does not apply in Wazio’s case, because it was the first time that he had filed freedom of information requests with the township.

“They have no intention of giving us that information before the election,” Hughes said.

Town Clerk Benson said he when he saw the extent of the request that he took it to the township board’s legal counsel.

“It’s time consuming to go through files,” Benson said. “When I saw the extent of the request I asked the attorneys about it.”

Benson said that the township board’s legal counsel, attorney Burt Odelson, analyzed the request and “gave it a legal analysis.”

“They can poke around all they want,” Benson said. “[The challengers] talk about term limits and pensions, but not one thing of how we run the township. We’ve reduced operating costs by 10 percent. If anything, we’re lean and mean.”

Murphy accused the Community First party of “overloading the system.”

“We asked for an extension,” Murphy said. “We haven’t heard back from [Community First] to my knowledge. All they want to do is harass us. They’re just trying to clog up the system and make the clerk’s office look bad.”

Some of the items requested—credit card receipts—the township doesn’t have because elected officials don’t have credit cards, Murphy said.

“They don’t understand what’s going on in the township,” the town supervisor added.

The most recent financial report posted on the township’s web site is for the fiscal year that ended on Feb. 29, 2012.

But Hughes says the information that is lacking are what is spent on part-time, elected township officials' health benefits, pensions, and expenditures on roads and other programs.

“There isn’t a lot of transparency with the current township government,” Hughes said. “They’re not posting any of that information. [The freedom of information act request] requested things outside of that.”

The Community First slate who are both current sitting trustees on the Crestwood and Chicago Ridge village boards, based on potential conflicts of interest. Toscas also is running for mayor of Crestwood.

Worth Township encompasses the communities of Oak Lawn, Evergreen Park, Hometown, Chicago Ridge, Worth, Alsip,  Merrionette Park and sections of Blue Island, Robbins, Crestwood, Palos Heights and Bridgeview.

The Unity Party of Worth Township has been calling all the shots for nearly two decades. This Freedom of Information request calls for basic documents--like their budget. They say there's 'a lot of transparency' but THEY CAN'T EVEN PRODUCE THEIR OWN BUDGET. What are they hiding? Its about time someone started looking into what they are doing with our taxpayer money. Instead of coming clean with the documents they run to their lawyers to help them hide these materials--and the taxpayers are footing the bill. Outrageous!

Joan, you should be ashamed of yourself for admonishing people who seek transparency in government. Are you trying to protect a friend who may have pulled some strings to get something done for you at some point in time?
In my opinion, Township government is one of the least efficient and unneeded forms of government in the entire state of Illinois, and as we all know the bar is not set very high in Illinois. Townships provide very few services and serve very little purpose, yet they each have a bunch of elected officials and staffs who spend money overseeing the very little that gets accomplished. In my opinion, Illinois should abolish township governments altogether and have what little services they provide transitioned over to the counties. We all know that there are plenty of underutilized staffers and administrators in each county who could fit the townships responsibilities into their schedules without any pain. There are currently 1,433 townships in Illinois, each with their own bureaucracy. It would save Illinois taxpayers millions of hard-earned tax dollars each year by not having to fund this nearly useless bureaucracy in each of the 1,433 townships across the state.

Joan - Since you seem to be in the know, I'll ask you. What EXACTLY does this Worth Township do and why is it needed???? And what happens if this Worth Township group is abolished? Will the heavens fall?
I did a search and came up with nothing substantial. I hope they do more than just collect $10,000 a year in salary plus health benefits, if true. And if Joan doesn't answer, anyone else can answer.

There is nothing shameful about questioning taxing bodies on how they spend our money. In fact, it is our civic duty. The fact that the incumbent party have been in office so long without a challenge makes the transparency question even more important. It appears that they have something to hide when they deny access to the most basic requests and have their friends try to scold anyone who questions them as if we were precocious children. Jack Murpy stated that the challenging party, Community First, doesn't know what is going on in township gavernment. How could anyone know what is going on when you hide the records and hide behind the township attorneys? One thing everyone knows, thanks to Community First, is that two incumbents are holding or intend to hold more than one office, collect two salaries and pension contributions, and double the burden to the taxpayer to pad their own pockets. We also know that, thanks to Community First again, that no matter who gets elected. the taxpayers of Worth Township will not be subject to salary increases for their elected township officials through 2017. Murphy and his bunch bowed to the pressure applied by the Community First pledge to freeze salaries. Chalk on up for the taxpayer! If Kevin Hughes can save the taxpayers money before he is even elected, imagine what he and his team can do after we vote them in. Clearly it is time for a change. Deny the FOIA request? Why? Worth Township voters deserve better. Something stinks here.

Sorry to disappoint you JR I have never asked for any favor or have a friend in the township. They take care of fighting to reduce our property taxes, provide rides to those that need it within the township, have a clinic for those that need it, help families at Christmas with gifts and clothes. You may think they are worthless but I feel they have done a lot of good.

i just recently moved into oak lawn from chicago and im saddened to think i may have just left a more transparent government . i dont understand whats wrong with transperancy, its just some FOIA requests MAN UP!!!!

The salaries were frozen for the next term by this board in January long before the United ticket was out and that is by law. The issue that frightens me is that the Community First Party are all followed and supported by Springfield and Cook County politicians. If you think Springfield and Cook County has been looking out for your interests by all means vote for them. Local politics and your tax dollars should never be managed by people indebted to individuals outside your community. Thanks for reading this post.

I think that's great that the Townships legal counsel "gave it a legal analysis". I'd be even more upset if he was providing an old family recipe. Wouldn't it be easier to provide all the FOIA documents, instead of bickering back and forth. Either side should be able to prove or disprove what has been transpiring. I would think that the United party would jump at the chance to put the appearance of hiding information from the Community first party and the Township voters . Call their hand and prove to the voters that everything is being done properly. Otherwise I for one believe the lack of forthrightness on behalf of the United party is a bad sign and would deprive them of my vote. You certainly can expect voters support if you can't be open about the workings of all the Township offices. As a voter and just as importantly a taxpayer, my interest is peaked and I want to see what's going on. We are entitled to know how our elected officials spend our money.

FOIA is a law designed to provide transparency in government, not to harass public officials. If Murphy feels harassed, there must be a reason why. He wants to stall this request until the election is over because he is ashamed of his record. That is the only conclusion we are left to draw. If he wants us to think differently about it, he needs to act differently. Just open the books like he was supposed to. He should have done so right away.

Some people just don't understand TRANSPARENCY in Government. They get very comfortable in their position and start not to care what residents or businesses think. Same thing happening in Evergreen Park.

NickMac, how much do you actually know about the Township and it's current government, aside from what has been posted in these forums and told to you by the Community 1st party in their door to door campaign? Every year they post the past years budget, levies and previous years spending for anyone and everyone who comes into the Township to read. Yes, that is very cloak and dagger of them. If I requested your budgets and spending from 1996 to present day, I'm assuming you would hand them over post haste. With little to no delay, right. That is EXACTLY what is being asked of the Unity Party and it is my belief that it is to make them look incompetent. At what point was this request for the documents made? Was it when the Community 1st Party stated they were running or did they procrastinate in their request so as to create this exact situation that they are in? I suggest some research for you my friend, then come on here and support your Community Party with actual facts and not simply hearsay.
